Alternative Dispute Resolution (ADR)

Our ADR attorneys serve as neutrals in a wide variety of matters, and all firm litigation attorneys serve as advocates for clients in alternative dispute settings. McGuire, Wood & Bissette, P.A. concentrates its efforts on tailoring creative alternative dispute resolution techniques uniquely suited to our client's specific needs. Firm attorneys strategically plan each matter by careful case evaluation, including litigation and business costs analysis; risk and exposure assessments; and examination of appropriateness of ADR under industry practices, contractual provisions, rules of the court and applicable statutory and case authority.

Our attorneys are experienced in all methods of case resolution, including arbitration, mediation and other forms of negotiation. Firm attorneys who serve as arbitrators and mediators and in other neutral capacities have vast experience in a wide variety of practice areas, including product liability, personal injury and property damage cases, land use, zoning and other regulatory matters, plus commercial litigation, business contracts, business partnerships, insurance, labor and employment, healthcare and environmental issues.

Services Provided

Arbitration: An arbitrator reviews the evidence submitted by the parties, decides the facts, and makes a binding decision. We can serve as arbitrators in all sorts of disputes, either alone or as a member of a panel.

Mediation: A mediator assists the parties in discussing the issues and agreeing to a voluntary resolution of a dispute. We regularly act as mediators in a wide variety of cases, whether pursuant to a court order or by an agreement of the parties.

Counsel: In relation to a matter where we are counsel for one party to litigation, we regularly are engaged in ADR on behalf of our client.
